PRIVACY POLICY

This Privacy Policy, covers the data collection practices of Plexus Promotions, LLC, d/b/a TaptIn (“TaptIn”) in connection with our goods and services (the “Service”) found at www.taptinapp.com, other domains by which we provide products and services online, and through our Mobile App. (collectively “Mobile App”). This Privacy Policy describes our privacy practices and those of our vendors, business partners, and advertisers (collectively the “Service Providers”), but we do not own, operate, or control, the privacy practices of such Service Providers.
We and our Service Providers collect and use information from or about you according to the Privacy Policy in effect at the time the information is gathered. This Privacy Policy may be changed at any time by our updating this page. Your continued use of the Service following any changes will mean that you accept such changes.
This Privacy Policy, and Terms of Use, together form the entire agreement between TaptIn! and you for your use of the Mobile App. By using our Service, you signify your consent to the data practices described in this Privacy Policy and the Privacy Policy and agree that your use of the Service and any dispute over privacy is subject to our Terms of Use, including without limitation, the terms regarding limitations on liability and application of the laws of the State of Maryland. If you do not agree, you should delete the Mobile App and not use it.

INFORMATION WE COLLECT

Age Restrictions
The Mobile App is intended only for use by persons aged 18 and over. If you are under the age of 18, please delete the Mobile App and do not use it. We do not intend to collect personally identifiable information (“PII”) from persons under the age of 18. If you are under the age of 18, do not provide us with PII, use our Service, or use the Mobile App. If we learn that we have collected PII from a person under the age of 18, we will promptly delete that information. If you believe that we collected information from a person under the age of 18, contact us at privacy@taptinapp.com.

Personal Information
The information we collect about you includes:

Geo-location
The Mobile App makes use of your smartphone’s geo-location mechanism. In order to use the Mobile App, you consent to our collecting your geo-location while signed into the Mobile App is open, and sharing you geo-location information with third parties within the geo-fenced area as set forth below. We do not collect your geo-location while the Mobile App is closed.

Personally Identifiable Information
If you consent by signing in to the Service and/or creating a profile, we may collect and share your personally identifiable information (“PII”) with third parties, including other users, featured local businesses, and other third-parties within the geo-fenced area for marketing purposes. If you consent by signing into the service, we may collect, in addition to your geo-location, your:

• Name
• Gender
• Avatar selected to signal mood
• Status updates
• Uploaded content
• Posted comments and messages
• Personal email address
• Phone number

Cookies

We may collect and store cookies containing non-PII in log files on your browser or mobile app such as:

• The domain and host from which you access the Internet
• The IP address of the computer you use
• Your browser software
• The date and time you access the Mobile App
• UDID or RFID

CALIFORNIA PRIVACY RIGHTS AND DO NOT TRACK DISCLOSURES
TaptIn will not override your privacy settings without your consent.
In addition to the PII described above, TaptIn may collect the following information from its Mobile App users:

• UDID or RFID
• Your activity as a user of the Service, including the date and time that you access the Service
• The geo-location of your mobile device
• Any coupons that you access through push-out notification or other means

Under California Civil Code Section 1798.83, California residents who have an established business relationship with us have the right to request that we provide certain information regarding the disclosure of their personal information to third parties for their direct marketing purposes during the immediately preceding calendar year. You may send your request for such information to privacy@taptinapp.com Requests shall only be accepted via this email address. We shall not be responsible for requests made over the telephone or by any other means.

Canadian and European Union Users
We do not intend to collect PII from Canadian and European Union users. If you are in Canada or the European Union, do not provide us with PII, use our Service, or use the Mobile App. If we learn that we have collected PII from a user in Canada or the European Union, we will promptly delete that information.

USE AND SHARING OF INFORMATION
We collect and store all PII that is volunteered through the use of Mobile App. We use this PII to:

• Provide access to the Service and to provide you with requested services and customer support and to process and respond to your inquiries;
• Personalize, customize, measure, and improve our services, content, and advertising and otherwise to enhance your experience of the Service;
• Prevent, detect, and investigate potentially prohibited or illegal activities, and enforce the Terms of Service;
• Analyze the accuracy, effectiveness, usability, or popularity of the Service;
• Generate and review reports and data about our user base and service usage patterns;
• Compile aggregate data for internal and external business purposes;
• Resolve disputes and troubleshoot problems;
• Contact you with information, including promotional, marketing, and advertising information and recommendations that we believe may be of interest to you;
• Provide you with other services requested by you as described when we collect the information;
• Send emails or push notifications to your mobile device to provide updates about the Service, coupons and personalized advertising messages, and other relevant messages;
• Share with third parties for marketing purposes; and
• As otherwise stated in this Privacy Policy or the Terms of Service.

Third-Party Contractors
We may share your information with third-party contractors who provide certain services to us or on our behalf, such as operating and supporting the Mobile App or otherwise responding to your customer service requests. These third-party contractors will only have access to the information needed to perform these limited functions on our behalf and are required to provide your information with at least the same level of protection and security as we use for the Mobile App.

Companies that Acquire Our Business or Assets
If we become involved in a merger, acquisition, sale of assets, securities offering, bankruptcy, reorganization, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we may share or transfer your information to a third party or parties in connection with the applicable transaction.

Our Affiliates
We may share some or all of your information with our parent company, subsidiaries and corporate affiliates, joint venturers, or other companies under common control with us. We will require these entities to comply with the terms of this Privacy Policy, as it may be amended, with regard to their use of your PII.

Other Users
By creating a profile, updating your status, posting messages, or uploading content on the Mobile App, you consent to our sharing such content, status update, messages, or comments, along with your chosen name with any user of the Service within the geo-fence.
By clicking “share” on uploaded content or posted message or comment, you consent to our causing the “shared” content to be posted to the Service, where the content will be visible to any person within the geo-fenced area and others in your social media network to view your profile.

Other Third Parties
We may share your PII relating to your use of the Mobile App, including your geo-location, with affiliated or unaffiliated third parties on an individual or aggregate basis for marketing purposes. These third parties include local businesses, the bars and nightclubs featured on the Mobile App, and others, including but not limited to event planners, promoters, and other venues who may use your personal information for market research and/or to develop personalized coupons and advertising messages to be delivered to you.

Disclosures Permitted or Required by Law
To the extent permitted by law, we may share your information with law enforcement, governmental agencies, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other Mobile App user to legal liability, or to protect our rights or property, or during emergencies when safety is at risk. We may also share your information in response to a warrant, court order, subpoena, or other legal process that we have a good-faith belief requires disclosure of the information.

HOW WE PROTECT AND RETAIN YOUR INFORMATION
If we retain PII on our systems, we restrict internal access to PII to employees, contractors, and agents who need to know that information in order to operate, develop, or improve our Mobile App and Services. However, the internet and mobile web are inherently insecure and so we are unable to guarantee that the security measures we take will not be penetrated or compromised or that your information will remain secure under all circumstances.
We retain information for active user accounts as long as it is necessary and relevant for our operations. In addition, we may retain information from closed accounts to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce the Terms of Use and take other actions permitted by law. The information we retain about you will be handled in accordance with this Privacy Policy.

YOUR PRIVACY CHOICES
Be aware that content you submit to the Mobile App (profile info, status updates, messages, images, and comments, etc.) is publicly visible, not private and cannot be considered private PII.

HOW TO CONTROL COLLECTION OF YOUR PII ONLINE
In order to create a profile, post messages or upload content, you must log in to the Mobile App, in which case you consent to our collection and use of your PII as described above. If you do not want us to collect and use your PII or geo-location, you should not use the Mobile App.

Social Media
We may engage with you on third-party social media sites like Facebook, if you engage with us. By doing so, you “opt in” to sharing your content with us. Be aware that such content (PII, images, captions and comments, etc.) that you submit (upload, post, comment, share, “like”, etc.) to third party social media sites (including any of our message boards or tweets) is publicly visible, not private and cannot be considered private PII. To manage social media notifications you receive, correct or delete your PII, or adjust your privacy settings, access the profile section of your social media accounts and follow the directions there. Managing Email Communications


When you download and sign into the TaptIn app we will collect your email address.
We may share your email address with our third party partners and providers.

We may communicate with you through such email address. You can choose not to receive email communications from us by following the “unsubscribe” instructions in email communications you receive from us.

You specifically agree to receive any email notification to verify any redeemed award or prize from TaptIn or any of its third party providers, partner venues, partners events or partner advertisers.

Choice of Law
By using our Mobile App, you signify your consent to the data practices described in this Privacy Policy and agree that your visit and any dispute over privacy is subject to our Terms of Use, including without limitation, the terms regarding limitations on liability and application of the laws of the State of Maryland.
